Clergy Act Passed by Congress - Allows Opting Back in to Social Security

The Senate completed action on September 30, 2026, approving the Clergy Act previously passed by the House of Representatives.

Under the Clergy Act, ministers who previously opted out of Social Security may elect to rejoin during a two-year window starting in 2029. At that time, they will start making contributions by paying the SECA (Self Employment Contributions Act) tax rate of 15.3%. From time to time, last in 2002, Congress has opened a similar window for clergy, but usually required some back payments. This time, an opting-back-in minister will not have such a requirement beyond starting to pay the SECA tax.

FCMM will post additional information on re-joining Social Security as it becomes available.

Ministers' previously irreversible decision on Social Security can be rescinded, but not until 2029.
